Constitutionalism and Globalization: Some Reflections

Abstract

The article refers to two concepts: constitutionalism and globalization, which, although often used, their content scope has not yet been clearly defined. The essence of the text, however, is to answer the question of what is the interrelation of these two concepts and what is the significance of the rule of law in this context. The article also refers to the impact of globalization on the future of constitutionalism. In the conclusion, the author points out that globalization, the need for which is evident, must not lead to the abandonment of the fundamental values of constitutionalism as they have developed in the state.  The core elements are the guarantee of human dignity, the principle of freedom and the principle of equality.  These anthropocentric fundamental values must be preserved in their functional core both within and outside the state, in the context of transnational activities.
